§ 1 Scope of Application
These terms of use govern the use of the website https://iks.haus and all related digital offerings (web portal, app, podcast, vodcast, social media channels) of the iks.haus platform, operated by iks.haus, FlexCo, Mariahilfer Straße 49/1/15, 1060 Vienna, Austria (hereinafter referred to as the "Operator").
By accessing the website and using it, you agree to these terms of use. If you do not agree with these terms, we ask that you do not use the website.
§ 2 Description of the Offering
iks.haus is an inclusive multimedia platform that provides content in the areas of culture, entertainment, environment, lifestyle, technology, news, astrology, and history. The content is offered in three languages (German, English, and BKS/Croatian) and is aimed specifically at LGBTQIA+ individuals, people with disabilities, and linguistic minorities. The platform includes a web portal, an app, podcasts, and vodcasts, as well as a presence on Spotify, YouTube, TikTok, Instagram, and Facebook.
The offering is generally accessible free of charge. The Operator reserves the right to make individual functions or content subject to registration or a fee in the future, but this will be announced separately.
§ 3 Availability
The Operator strives to ensure the greatest possible uninterrupted availability of the website. However, there is no claim to constant availability. The Operator is not liable for interruptions caused by force majeure, technical problems, maintenance work, or circumstances beyond its control.
§ 4 Intellectual Property and Copyright
All content published on the website (texts, images, graphics, audio and video files, logos, layouts) is protected by copyright and is the property of the Operator or the respective rights holders. Any reproduction, distribution, processing, or other use outside the limits of copyright requires the prior written consent of the Operator.
Sharing content via the social media functions provided on the website (share buttons) is expressly permitted.
§ 5 User Conduct and Community Guidelines
iks.haus stands for inclusion, diversity, and mutual respect. When using the website, especially in comment sections, forums, or other interactive features, users agree to:
- a) Not to publish content that is discriminatory, racist, sexist, homophobic, transphobic, ableist, or otherwise dehumanizing;
- b) Not to publish content that violates applicable law, in particular the Prohibition Act (VerbotsG), the Criminal Code (StGB), or the Equality Act (GlBG);
- c) Not to publish spam, advertising, or commercial content without prior permission from the operator;
- d) Not to publish content that violates the rights of third parties, in particular copyrights, trademarks, or personal rights;
- e) Not to publish personal data of third parties without their consent.
The operator reserves the right to delete contributions that violate these guidelines without prior notice and to exclude users from further use of the platform.
§ 6 User-Generated Content
To the extent that users publish their own content on the platform (e.g., comments), they grant the operator a non-exclusive, royalty-free, and unlimited right to use such content, to the extent necessary for the operation of the platform.
The responsibility for the content of user contributions lies solely with the respective user. The operator does not claim ownership of user contributions and assumes no liability for their accuracy, completeness, or legality.
§ 7 Accessibility
The operator is committed to designing the website to be accessible (Accessibility-by-Design). If you encounter any accessibility barriers when using the website, please inform us at iks@iks.haus. We will make every effort to remove reported barriers promptly.
§ 8 Disclaimer
The content of the website has been created with the utmost care. However, the operator assumes no liability for the accuracy, completeness, and timeliness of the information provided.
The operator's liability for slight negligence is excluded to the extent permitted by law, except for damages to life, limb, or health. Otherwise, liability is governed by statutory provisions.
§ 9 Links to External Websites
The website contains links to external websites of third parties. The operator has no influence on the content of these websites and assumes no liability for them. The respective provider is always responsible for the content of the linked pages. If any violations of rights are discovered, the relevant links will be removed immediately.

§ 11 Amendments to the Terms of Use
The operator reserves the right to modify these terms of use at any time. The current version is available on the website. Users will be informed in a suitable manner of any significant changes. Continued use of the website after the publication of amended terms of use constitutes acceptance of the changes.
§ 12 Applicable Law and Place of Jurisdiction
Austrian law applies, excluding the provisions on the application of foreign law and the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction for all disputes arising from or in connection with these terms of use is – where legally permissible – Vienna. Mandatory statutory provisions regarding the place of jurisdiction for consumers remain unaffected.
§ 13 Severability Clause
If any provision of these terms of use is or becomes invalid, this will not affect the validity of the remaining provisions. The invalid provision will be replaced by a valid provision that comes as close as possible to the economic purpose of the invalid provision.
